In Portugal, the school location of a student with special education needs was brought to court

This time, the issue regarding the placement of students with special education needs in public schools in Portugal was taken to court. The Almada Administrative and Tax Court is considering a request for expedited placement for a student who has not yet been placed in a public school.

The case does not seem to be limited to which school a single student will attend. It may also lead to discussion of the legal aspects of the placement and support problems faced by students with special education needs as the new academic year begins.

Ministry and education system institution were summoned to court

The hearing is scheduled for Tuesday, September 15 at 10.30 at the Tribunal Administrativo e Fiscal de Almada.

In addition to the family's lawyer, representatives of the Ministry of Education and Agência para a Gestão do Sistema Educativo, which is responsible for the management of the education system, were also invited to the process.

In the lawsuit filed, it is requested that the student be placed quickly in a public school.

Inclusão Efetiva: Other students do not know their school either

The Inclusão Efetiva movement argues that some students with special education needs still do not know which school they will attend, even though the academic year has started.

The movement also alleges that some schools are denying students access to outside therapists, even when resources within the institution are inadequate.

The scope of these claims and whether they apply to every school must be evaluated independently. However, the issue brings to the fore again that inclusive education in Portugal is not just about enrolling the student in school, but also about actually having access to the support they need.
