When it comes to the energy giant in Portugal or other markets where it is active, the first name that comes to mind is undoubtedly EDP. However, the company's difficult struggle with the tax office in the international arena has been talked about more recently than its balance sheet profits. Confronted with tax administrations in different countries, especially Portugal, Brazil and the USA, EDP is in the middle of a huge tax dispute totaling 1.4 billion euros.

When we look at the field reality and the numbers, the fact that even one of Portugal's biggest players faces such great financial and legal risks causes the cards to be shuffled again in the industry.

The Biggest File on the Table: Dam Sale

The hottest and highest-priced topic of the dispute is the sale of the operating privileges of six dams in Portugal. EDP ​​transferred this dam portfolio to Movhera within Engie in 2020. The biggest crisis between the Tax Office and the company breaks out at this point:

Claim of 335.2 Million Euros: According to the audit report presented by the Portuguese Tax and Customs Administration at the end of April, there are corporate tax and stamp duty deficiencies resulting from the dam sale. Even the size of this single file on the table reaches 335.2 million euros.

EDP's Attitude is Clear: The energy giant, which announced a profit of 732 million euros in the first half of the year, does not accept this interpretation of the tax office. The company management clearly states that it will not pay any tax assessments until the court process is concluded.

Timeout Pressure: In the social and legal aspects of the matter, non-governmental organizations follow the process closely. Terra de Miranda Cultural Movement (Movimento Cultural da Terra de Miranda) describes EDP's attitude as a time-saving strategy and points out that there are less than two months until the alleged tax debt expires.

How Does It Affect Budgets and Strategies?

It is nothing new for the markets that companies go to court in tax disputes of this scale. However, an amount of 1.4 billion euros is a risk item that cannot be ignored even for a giant like EDP. The decisions to be issued by the courts in the coming days will directly affect not only EDP's balance sheet but also the climate of energy investments in Portugal.
